Tariffs, Refunds, and Related Litigation: Advice on How to Navigate an Ever-Shifting Environment

The Supreme Court’s decision invalidating tariffs imposed under the International Emergency Economic Powers Act (IEEPA) has created uncertainty for businesses. Although the Court invalidated the tariffs, it did not resolve whether—or how—businesses will receive refunds for duties already paid. The Court of International Trade (CIT) has ordered U.S. Customs and Border Protection to refund IEEPA duties, setting the stage for significant refunds and follow-on litigation. 

This webinar will help businesses navigate the ever-shifting environment. It will cover the administrative remedy being developed to process refunds, likely dispute points, and potential third-party claims to recovered refunds. The webinar will also provide guidance on how to maximize refunds and prepare for potential litigation over them.  Finally, the webinar will touch on recent developments over tariffs, including the CIT’s decision to invalidate the 10% global tariff that the administration imposed in the wake of the Supreme Court’s ruling on the IEEPA tariffs.

John “Fritz” Scanlon is a former federal prosecutor and seasoned trial lawyer who has tried several federal criminal cases to verdict, including matters involving securities fraud, wire fraud, bribery, health care fraud, money laundering and violations of the federal Anti‑Kickback Statute. He has also led major civil cases, international arbitrations and judgment enforcement matters. 

Scanlon is co‑leader of the firm’s tariff refund task force, advising clients on potential refund rights before and after the Supreme Court’s decision in Learning Resources Inc. v. Trump. 

His practice focuses on representing companies and individuals in government investigations, corporate crises, internal investigations, criminal indictments, judgment enforcement proceedings and other significant business and legal matters. 

Before joining Quinn Emanuel, Scanlon served as an assistant chief in the Justice Department’s Fraud Section, where he supervised prosecutors nationwide handling some of the largest and most complex white‑collar cases. He personally prosecuted defendants ranging from former NFL players to corporate executives and led corporate resolutions involving publicly traded health care companies. Earlier in his career, he practiced at two international law firms, representing clients in criminal, civil and arbitral matters, including major international arbitrations and judgment enforcement proceedings.

Dennis H. Hranitzky is a partner in Quinn Emanuel’s New York office and head of the sovereign litigation practice. He focuses on multinational litigation, including disputes against sovereign states and their instrumentalities, as well as contentious cross‑border insolvency matters. He also has decades of experience leading multinational creditors’ rights and collection litigation, having run matters in more than 15 countries on four continents. 

Hranitzky was co‑lead of the legal team “highly commended” by the Financial Times in 2014 for representing Argentina’s largest creditor in multinational litigation and judgment enforcement. He received The American Lawyer’s Grand Prize for Global Dispute of the Year in 2016 for the Argentina debt default litigation and is one of only five individuals recognized by Legal 500 as a “Leading Lawyer” in international litigation every year since the category began in 2016. He frequently writes and lectures on sovereign litigation, international litigation and cross‑border insolvency, and has been a visiting lecturer at Stanford Law School and Georgetown University Law Center.
