The Supreme Court’s decision to invalidate tariffs imposed under the International Emergency Economic Powers Act (IEEPA) has created uncertainty for businesses. Although the Court invalidated the tariffs, it did not resolve whether, or how, businesses will receive refunds for duties already paid. The Court of International Trade (CIT) has ordered U.S. Customs and Border Protection to refund IEEPA duties, setting the stage for significant refunds and future litigation.
AEM’s Alex Russ will moderate the webinar, and speakers John “Fritz” Scanlon and Dennis Hranitzky of Quinn Emanual will cover the administrative remedy that is being developed to process refunds, likely dispute points, and potential third-party claims to recovered refunds. Scanlon and Hranitzky will provide guidance on how to maximize refunds and prepare for potential litigation, and will touch on recent developments, including the CIT’s decision to invalidate the 10% global tariff that the administration imposed in the wake of the Supreme Court’s ruling on the IEEPA tariffs.
